Terms & Conditions of Use

By using OPEN Client, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the service.

OPEN Client allows you to browse schedules, book classes, send/receive messages with teachers, and purchase access passes or subscriptions from participating studios.

Users under 16 are not permitted to register or use OPEN Client. Studios may access and export client data from their studio’s user base only.

If you are between 16 and 18 years old, we recommend using the app under supervision or with parental consent.

Payments & Subscriptions

Payments are processed via Stripe or the App Store / Google Play, depending on your purchase method. Middlepoint Solutions does not store credit card data on its servers.

OPEN Client acts solely as a facilitator. In case of payment disputes, clients must contact the studio directly. We do not mediate financial disagreements.

Refunds and cancellations are subject to each studio's individual policies.

Studios are solely responsible for the accuracy of their schedules, prices, cancellation terms, and content. OPEN Client is not liable for changes, misinformation, or failure of service by individual studios.

Personal Data & GDPR

OPEN Client collects and stores the following personal data when you create an account: name, email, phone number, address, birthdate, injury info (if provided), booking history, and geolocation (if enabled).

This data is stored securely on our servers and is only shared with the studio(s) you connect to. We do not sell user data.

Under the GDPR (Regulation EU 2016/679), you have the right to access, correct, or request deletion of your data. Contact info@openclient.app for data-related inquiries.

Account Deletion

You can delete your account at any time from the app settings. This will permanently erase your profile data. However, studios you’ve booked with may retain attendance records in accordance with their legal obligations.

Third-party Services & Analytics

OPEN Client uses third-party services including Stripe, Firebase, and Google services. These providers may collect anonymized log and usage data (e.g. crash reports, session duration) to improve functionality and performance.

Security

We follow industry standards to protect your information. However, no system is 100% secure. Use the app at your own risk.

Health & Fitness Disclaimer

Any information provided through the app, including class content, should not be considered medical advice. Always consult with a qualified healthcare provider before beginning any fitness program.

User-Generated Content

When creating events or workshops on OPEN Client, you are solely responsible for all content, descriptions, images, and information you publish. You agree not to post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable.

OPEN Client reserves the right, but not the obligation, to monitor all content posted and to remove any materials that violate these terms or that we find objectionable for any reason, without prior notice.

We do not endorse, verify, or guarantee the accuracy of any user-created events or content. Participation in any event is at your own risk.

Content Moderation & Removal

OPEN Client maintains the right to moderate all content on the platform. We may review events before or after publication and may remove any content that violates our terms without prior notice.

Users can report inappropriate events or content through the app. We will review reported content and take appropriate action, which may include content removal, account suspension, or termination.

Repeated violations of our content policies may result in permanent account suspension and prohibition from using the platform.

Intellectual Property Rights

By posting content on OPEN Client, you confirm that you own or have the necessary rights and permissions to use all materials, including images, descriptions, and other content in your events.

You grant OPEN Client a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content within the platform for the purpose of providing and promoting our services.

OPEN Client respects the intellectual property rights of others. If you believe your work has been used in a way that constitutes copyright infringement, please contact us at info@openclient.app with the subject line "Copyright Claim."

Infringement of third-party intellectual property rights is strictly prohibited and may result in content removal and account termination.

Liability Limitations for User Content

OPEN Client is a platform that facilitates connections between event hosts and participants. We are not responsible for the actions, content, services, or products of event hosts or any participants.

You agree to indemnify and hold harmless Middlepoint Solutions SL, its affiliates, officers, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising from your content, your use of the platform, or your violation of these terms.

We disclaim all warranties and representations regarding user-generated content. Event quality, safety, legality, or accuracy are the sole responsibility of the event creator.

Event Standards & Safety

As an event host, you agree to comply with all applicable local, national, and international laws and regulations related to hosting events. This includes obtaining any necessary permits, licenses, or insurance.

Events must maintain appropriate safety standards and precautions. Hosts are responsible for ensuring participant safety and providing adequate information about any potential risks.

OPEN Client reserves the right to remove events that appear to present unreasonable safety risks or that violate applicable laws or regulations.

We do not verify the qualifications, experience, or certifications of event hosts. Participants should conduct their own due diligence before attending any event.

Prohibited Content & Activities

The following content and activities are strictly prohibited on OPEN Client:

• Content that promotes discrimination, hatred, or violence against individuals or groups

• Sexually explicit material or nudity

• Content that promotes illegal activities, substances, or services

• Fraudulent, deceptive, or misleading content regarding events

• Content that infringes on any third party's rights, including intellectual property

• Content related to high-risk activities without proper safety disclaimers

• Events that promote or constitute multi-level marketing, pyramid schemes, or unauthorized financial activities

Changes to Terms & Notifications

OPEN Client reserves the right to update these Terms and Conditions at any time. We will notify users of material changes via email or in-app notification.

Continued use of the platform after changes indicates your acceptance of the modified terms. If you do not agree with the updated terms, you must cease using the service.

Dispute Resolution

Any disputes between event hosts and participants should first be addressed directly between the involved parties. OPEN Client does not mediate such disputes unless they involve violations of our platform terms.

In the event of a dispute between you and OPEN Client, we agree to first attempt to resolve it informally. If this is not possible, all disputes shall be resolved according to the laws of Spain.

You agree that any legal action related to these terms shall be filed exclusively in the courts located in Barcelona, Spain, and you consent to the jurisdiction of these courts.

Children Under 16

This app is not intended for users under the age of 16. If we become aware of an account created by a child under 16, we will remove it.

Legal Jurisdiction

Any legal disputes will be resolved under the laws of Spain. By using this service, you consent to the jurisdiction of Spanish courts.
